February 1 Deadline Looms for NY Employers
Pay Rate and Payday Forms to Employees Are Due
NEW YORK, Jan. 26, 2012 /PRNewswire-iReach/ -- The February 1 deadline for employers to provide their employees the Pay Rate and Payday form required under the New York Wage Theft Prevention Act (WTPA) is rapidly approaching. Failure to provide employees compliant forms could result in fines of up to $50 per employee per week of non-compliance.
PayRateForms.com, generates compliant forms, for most employees, at a cost of $1.99 per form with no set-up fee. Initially designed to assist the film industry generate their new hire notifications, also required by the WTPA, PayRateForms.com has been generating compliant WTPA forms since June 2011. In addition to generating single forms, the website offers a bulk upload feature, enabling employers to generate up to 300 forms at a time.
In order to be compliant, the WTPA Pay Rate form must include:
- Rate or rates of pay, including overtime rate of pay (if it applies)
- How the employee is paid: by the hour, shift, day, week, commission, etc.
- Regular payday
- Official name of the employer and any other names used for business (DBA)
- Address and phone number of the employer's main office or principal location
- Allowances taken as part of the minimum wage (tips, meal and lodging deductions)
The Labor Department has released nearly 50 templates in order to assist employers with becoming compliant. A provision in the law allows modification of the form, so long as all of the information required by law is presented.
The form must be given both in English and in the employee's primary language (if the Labor Department offers a translation). The Department currently offers translations in Spanish, Chinese, Haitian Creole, Korean, Polish and Russian.
Employers are required to obtain a signed and dated copy from employees, as well as provide a copy of the form to employees for their own records. Should the employee refuse to sign, the employer should make a note on their copy.
For more information on the WTPA, employers should refer to the Department of Labor's WTPA FAQ page. Prior to completing forms, or utilizing a service such as PayRateForms.com, employers should consult with their CPA or legal counsel to assist in complying with the WTPA.
