Gold Bennett Cera & Sidener LLP Announces Class Action Lawsuit Against Aspeon, Inc. and Two of Its Officers and Directors

SAN FRANCISCO, Oct. 13 /PRNewswire/ -- Gold Bennett Cera & Sidener LLP
announced today that it had filed a class action in the United States District
Court for the Central District of California on behalf of purchasers of
Aspeon, Inc. ("Aspeon") (Nasdaq: ASPE; ASPEE) common stock during the period
between October 28, 1999 and September 28, 2000 (the "Class Period"),
Case Number SA-CV-00-1014-DOC(EEx). The complaint charges Aspeon, its
President, Chairman and CEO Richard P. Stack and its CFO Horace M. Hertz with
violations of the Securities Exchange Act of 1934. Plaintiff seeks to recover
damages on behalf of all purchasers of Aspeon common stock during the Class
 Period.
The plaintiff is represented by the San Francisco law firm of Gold Bennett
Cera & Sidener LLP. For over 30 years, Gold Bennett Cera & Sidener LLP and
its predecessors have successfully engaged in complex commercial litigation,
including shareholder, consumer and antitrust class actions, in federal and
state courts throughout the United States, recovering hundreds of millions of
 dollars for its clients.
Aspeon, formerly Javelin Systems Inc., designs, develops, markets, and
sells open system touch screen point-of-sale computers which are sold
primarily to the foodservice and retail industries.
On September 29, 2000 Aspeon announced that it would restate its first
quarter 2000 financial statements as a result of accounting misstatements. On
October 10, 2000, Aspeon announced that it would require additional time to
file its Form 10-K report for the fiscal year ended June 30, 2000, and would
not meet its previously announced October 13, 2000 filing date. The Company
did not specify a new target filing date. Upon these disclosures, the
Nasdaq Stock Market halted trading in Aspeon pending "additional information
requested" from the Company. The last trade was at $1.50 per share -- a
decline of 95% from its Class Period high of $30.00 per share.
If you are a member of the Class described above, you may, no later than
December 11, 2000, move the Court to serve as lead plaintiff of the Class, if
you so choose. In order to serve as lead plaintiff, however, you must meet
certain legal requirements. If you wish to discuss this action or have any
