Houston Law Firm Vujasinovic & Beckcom Files Toyota Recall Catastrophic Injury Lawsuit in Los Angeles

 

HOUSTON, March 29 /PRNewswire/ -- The Houston, Texas personal injury law firm of Vujasinovic & Beckcom, PLLC filed a lawsuit today in Los Angeles County, California, on behalf of four businessmen who were injured in a vehicle crash during a business trip in the Township of Pittsfield, Washtenaw County, Michigan.  

The crash occurred on February 13, 2010, while the businessmen occupied a rented 2010 Toyota Camry that was under three separate recalls related to a defective acceleration control and braking system.  Hertz Corporation rented the 2010 Camry to the businessmen after Toyota recalled this vehicle.  

Attorney Vuk Vujasinovic represents Dennis Grainger, Ted Hansen, Jeff Munoz and David Turner in their claims against Toyota Motor Sales, U.S.A., Inc., Toyota Motor North America, Inc., Toyota Motor Corporation, and Hertz Corporation.  According to the lawsuit, the Camry would not stop and crashed into another vehicle at a high rate of speed.  The case is No. BC 434646, Dennis Grainger, et al. vs. Toyota Motor Sales, U.S.A., Inc., et al., in the Superior Court of the State of California, County of Los Angeles.

One of the occupants of the Camry sustained significant internal injuries which required the removal of a major portion of his intestines, bowel and colon.  All of the occupants sustained various orthopedic and other injuries.

"Toyota knew it had a problem with these vehicles long ago, and still the company is dragging its feet on properly addressing the problem," says Mr. Vujasinovic.  "Hertz knew this was a recalled Toyota, yet it rented the vehicle anyway."

Mr. Vujasinovic says Toyota and Hertz have not responded to his requests for additional information on the 2010 Toyota Camry involved in this crash, including his request for data that should be on the vehicle's data event recorder, or "black box".  "Toyota is very secretive about the data on its black boxes, and makes you sue them to get it," says Mr. Vujasinovic.

According to Mr. Vujasinovic, this lawsuit is different than many of the other Toyota lawsuits that have been filed throughout the United States.  "The occupants of the defective Toyota in this crash survived and will be able to tell what happened."

Mr. Vujasinovic points to another distinguishing feature of this case: this Toyota was a virtually brand new rental vehicle, which Hertz provided to the businessmen after it was recalled.  "Toyota and Hertz should be asking each other a lot of questions about the rental of this car which was under three separate recalls, and about what should be done in the future about the millions of Toyota rental vehicles under recall," says Mr. Vujasinovic.

Toyota has recalled over 8 million vehicles worldwide due to unintended acceleration and braking problems.  The National Highway Traffic Safety Administration ("NHTSA") currently links 52 deaths to crashes reportedly caused by Toyota's acceleration problems.  

Toyota recommends a fix which involves replacing floor mats and adjusting gas pedals.  However, various automotive safety experts and others point to the electronics systems in the vehicles as the source of the problem.  NHTSA has recently received over 100 complaints of unwanted acceleration after Toyotas were supposedly fixed under Toyota's program.
