Notice to Florida Direct Purchasers of Cement and Concrete of Price Fixing Lawsuit Filed by Gilman and Pastor, LLP
BONITA SPRINGS, Fla. and BOSTON, Nov. 13 /PRNewswire/ -- Gilman and Pastor, LLP filed a class action lawsuit on October 30, 2009 in the United States District Court for the Southern District of Florida on behalf of all individuals or entities who purchased Portland Cement or Ready Mix Concrete in Florida directly from any of the Defendants, including Cemex Corp., Florida Rock Industries, Inc., Holcim (US), Inc., Lafarge North America, Inc., Lehigh Cement Company, Suwannee American Cement LLC, Titan America LLC and Votorantim Cimentos North America, Inc., Oldcastle Materials and also includes all of their wholly owned subsidiaries, including but not limited to: Prestige AB Ready Mix, Inc., Anderson Columbia Co., American Cement Co., Preferred Materials, Continental Florida Materials, Rinker Materials and Tarmac America. The Proposed Class is seeking treble damages and injunctive relief under Section 1 of the Sherman Act.

Plaintiffs allege that Defendants eliminated competition in the markets for Cement and Concrete by charging artificially high prices for these products in Florida and elsewhere from at least January 1, 2000 to the present. Plaintiffs further allege that Defendants facilitated this conspiracy through in-person meetings, telephone conversations, and other communications. The complaint details the specific employees who participated in the conspiracy as well as the locations at which illegal pricing was discussed.
