CamelBak Files Suit Against Blackhawk for Patent and Trademark Infringement

Apr 30, 2001, 01:00 ET from CamelBak Products, Inc.

PETALUMA, Calif., April 30 /PRNewswire/ -- CamelBak Products of Petaluma,
Calif., has filed suit against Blackhawk Industries of Chesapeake, Va., for
willful infringement of CamelBak's patent and trademark rights.
The complaint alleges that Blackhawk, a former CamelBak distributor, is
selling hydration systems that infringe CamelBak's patent rights. It also
charges Blackhawk with unauthorized use of the CamelBak(R) trademark and
unfair competition in connection with the marketing of Blackhawk's HydraStorm
 hydration system.
The complaint was filed on April 17, 2001 in the U.S. District Court for
 the Northern District of California.
CamelBak is asking the Court to enjoin Blackhawk from selling all products
containing the patented reservoir. It also asks that all offending systems be
removed and destroyed. The suit further states that the patent and trademark
infringement is "willful" because Blackhawk was a former CamelBak distributor.
CamelBak(R) systems, which are worn like a backpack or added to a larger
pack, provide hands-free access to a cool, clean water supply anywhere and
anytime. CamelBak systems allow military and law enforcement personnel to
drink water on the move, enabling them to keep their eyes and hands focused on
 their missions.
CamelBak systems are used by every branch of the United States Military,
the U.S. Border Patrol, tactical law enforcement, as well as the armed forces
of many foreign countries. The CamelBak system enables all of these
professionals to operate at peak performance. The systems provide a tactical
advantage by providing easy access to a cool, clean water supply in virtually
any situation. They are ideal for use in hot and humid conditions.
The first CamelBak hydration system was created in 1988. Today CamelBak
Products, Inc. offers the most technologically advanced hydration systems for
the recreational, military, law enforcement, and occupational health and
 safety fields.
