NEW YORK, Dec. 19, 2016 /PRNewswire/ -- The federal court overseeing hundreds of Taxotere permanent alopecia lawsuits has taken the unusual step of establishing Plaintiffs' and Defendants' Settlement Committees. According to a Pretrial Order issued in the U.S. District Court, Eastern District of Louisiana, members of these committees are to engage in continuous general settlement discussions on a regular basis, rather than partake in detailed discovery, trial preparations, and presentation at trial, as those activities could distract the parties from "pursuing avenues for potential resolution of some or all of the issues" in the Taxotere litigation. More than 260 Taxotere lawsuits are now pending in the multidistrict litigation underway in the Eastern District of Louisiana, all of which were filed on behalf of cancer patients who allegedly experienced permanent alopecia, or hair loss, following treatment with the chemotherapy agent. Temporary hair loss commonly occurs with chemotherapy. However, Taxotere plaintiffs claim that the drug is more likely to result in permanent hair loss compared to other, equally effective medications. While Taxotere has been on the market since 1996, its U.S. labeling was only updated in December 2015 to note that "cases of permanent alopecia have been reported." However, information regarding this potential side effect was provided to doctors and patients in Europe as early as 2005, while the Canadian label was updated in 2012.
The Taxotere multidistrict litigation was established in October 2016 to allow all federally-filed hair loss claims to undergo coordinated pretrial proceedings, thereby conserving the resources of the courts, parties and witnesses involved in the lawsuits. When the litigation was established in October, 33 cases were initially transferred to the Eastern District of Louisiana. The increase in filings since then indicates that this litigation could ultimately grow to include hundreds of additional Taxotere lawsuits.
