APT MotoVox Group, Inc. Files Patent Infringement Lawsuit Against Monster Moto; Seeks Preliminary Injunction
KANSAS CITY, Mo., July 15, 2014 /PRNewswire/ -- APT MotoVox Group, Inc. ("MotoVox"), announced that it filed a motion yesterday for a preliminary injunction against Monster Moto and former employees of MotoVox in the United States District Court for the Western District of Missouri.
APT MotoVox Group is requesting that the Court enter a Preliminary Injunction to enjoin Monster Moto, LLC, Olen Rice, Robert A. Rice, Sr., Jon Umsted, and Kenneth Francis ("Defendants") from (1) ongoing infringement of design patents; (2) misappropriation of trade secrets; (3) breach of contract; and (4) tortious interference with business expectations.
APT Group seeks the requested injunction to (1) preclude Defendants from making any further sales of patent Infringing Products, (2) order Defendants to contact Monster Moto's retail customers and instruct them to stop their sales and return all Infringing Products to Monster Moto, (3) order Defendants to stop all advertising, including all Internet advertising, that depict, promote, or otherwise mention the above-listed Infringing Products; (4) order Defendants to refrain from using any of MotoVox's trade secrets in the design or manufacture of any Infringing Products or for any purpose whatever; (5) order Defendants to comply with their contractual obligations set forth in their Service and Employment Agreements; and (6) order Defendants to refrain from making contact with any of MotoVox's existing retail customers, with respect to advertising or selling any Infringing Products.

The lawsuit filed earlier this month, APT Group, Inc. d/b/a MotoVox and APT IP Holdings, LLC v. Monster Moto, LLC, Olen Rice, Robert A. Rice, Sr., Jon Umsted, Kenneth Francis, and Beck Salander, contends that former employees of or consultants to APT Group left the Company to work for or otherwise assist Monster Moto to manufacture and sell minibikes identical in nearly all respects to MotoVox products by disclosing trade secrets and confidential information learned through their association with MotoVox, breaching contracts with MotoVox, and breaching fiduciary duties to MotoVox as equity holders.
