The suit alleges Starbucks repeatedly refused the worker's request for sign language interpreters in violation of the Americans with Disabilities Act (ADA).
"This lawsuit is a great example of the way that employment discrimination law can work to bring equal rights for all workers, even those with disabilities, to the workplace. According to the ADA, an employer must comply with a worker's reasonable request for accommodation. The only reason to deny such a request would be to avoid undue hardship to the business," said Shegerian.
"In this case, the employee held her job for seven years, allegedly making continuous requests for accommodations. An employer's refusal to grant the type of accommodations necessary for a disabled worker to fulfill job requirements can be a huge blow to the advancement of a career and reflect poorly on the company itself," Shegerian went on to say.
"Also at issue is the way in which Starbucks terminated this worker's employment. It's alleged that she was fired only after filing an EEOC complaint, and she was specifically fired for having tattoos which had been present during the full 7-year stint of her career with Starbucks," Shegerian commented. "The claim of retaliation under these circumstances is not surprising."
