Belmora, Ronald Coleman to challenge "Global Trademark Case" against Bayer
NEW YORK, May 2, 2016 /PRNewswire/ -- Renowned trademark attorney Ronald Coleman has joined forces with Belmora LLC to litigate against the Bayer Corporation, from creating an unusual extension of U.S. intellectual property law that would give large foreign corporations global trademarks and trademark rights in the United States without any registration or use in the U.S.
Belmora's legal dispute with Bayer originated from a U.S. Patent and Trademark Trial and Appeals Board which was moved to U.S. District Court, and most recently was before the Fourth Circuit Appeals Court. Belmora has fought Bayer's unusual extension of U.S. trademark privileges to foreign brands that many believe to be unconstitutional – an extension for which Bayer is arguing. Key observers worry that if U.S. courts side with Bayer in the matter, many American businesses will be adversely affected, by facing an onslaught of lawsuits against their American trademarks from foreign competitors with similar foreign marks. The Belmora vs. Bayer case may ultimately warrant an appearance before the U.S. Supreme Court.
