Bracewell & Giuliani LLP Wins Jury Verdict for NCI Group Inc.

HOUSTON, Aug. 17, 2011 /PRNewswire-USNewswire/ -- MBCI, a division of NCI Group, Inc. received a favorable jury verdict, with damages and fees totaling $704,884, in a lawsuit it brought against Cannon Storage Systems d/b/a Vern Cannon Company and Vern Cannon. The verdict upheld the plaintiff's allegations of failure to pay against defendants, and sided with the plaintiff on the defendants' claims for breach of warranty, fraud, deceptive trade practices, negligent misrepresentation, business disparagement, tortious interference with prospective business relations and tortious interference with contract, awarding nothing to the defendants.  In addition, claims were also asserted against MBCI by the owners of 16 metal building projects in Oklahoma, Texas and Florida. Both defendants and the project owners alleged that MBCI's Ultra-Dek® roofing panels were defective. The jury rejected this allegation and found in favor of NCI on the project owners' claims for violation of the Texas Deceptive Trade Practices Act, based upon an alleged breach of the implied warranty of merchantability, awarding nothing to the project owners. The project owners had sought approximately $30 million in actual damages, punitive damages and attorneys' fees.
