If you received call(s) from Satellite Systems Network (SSN) promoting Dish Network, L.L.C. (Dish) from May 1, 2010 through August 1, 2011 and were on the National Do Not Call Registry and/or SSN or Dish's do not call lists, your rights may be affected by class certification in Krakauer v. Dish Network, L.L.C., Case No. 14-cv-33, U.S. Dist. Court, Middle District of North Carolina.

TO: ALL PERSONS WHO MEET THE FOLLOWING CRITERIA:

(1) ALL PERSONS WHOSE TELEPHONE NUMBERS WERE ON THE NATIONAL DO NOT CALL REGISTRY (NDNC) LIST FOR AT LEAST 30 DAYS PRIOR, BUT WHO RECEIVED TELEMARKETING CALLS FROM SATELLITE SYSTEMS NETWORK (SSN) TO PROMOTE DISH NETWORK, L.L.C. ("DISH") BETWEEN MAY 1, 2010, AND AUGUST 1, 2011 ("NDNC CLASS"); AND/OR

(2) ALL PERSONS WHOSE TELEPHONE NUMBERS WERE ON THE INTERNAL DO NOT CALL LIST OF DISH OR SSN ("IDNC LISTS"), BUT WHO RECEIVED TELEMARKETING CALLS FROM SSN TO PROMOTE DISH BETWEEN MAY 1, 2010, AND AUGUST 1, 2011 ("IDNC CLASS").

Dr. Thomas H. Krakauer (the "Plaintiff") alleges that the Defendants, DISH and SSN, violated the federal Telephone Consumer Protection Act (TCPA) because it prohibits telemarketing to people on the National Do Not Call Registry or who asked DISH and/or SSN not to call them. The lawsuit asserts that Defendant DISH owes monetary damages to Plaintiff and class members. DISH denies any wrongdoing, and SSN is out of business. The Court has not ruled on the merits of Plaintiff's claims or on the denials, defenses and other claims raised by Defendant.

The Court has ruled that this lawsuit may be maintained as a class action, meaning that the claims for restitution, declaratory and injunctive relief, and attorneys' fees and costs can be pursued not only by the Plaintiff, Dr. Thomas H. Krakauer, but also on behalf of two classes consisting of people who meet the criteria outlined on the following page. The Court has named Dr. Krakauer as representative for both classes in whole, and his attorneys, Bailey & Glasser LLP, Broderick Law, P.C., and The Law Office of Matthew McCue as counsel for both classes (collectively referred to as "Class Counsel"). The Court has certified two classes of persons who meet the criteria above. The United States District Court for the Middle District of North Carolina authorized this Notice.

Either choice has consequences, which you should understand before making your decision.
