Buchanan Announces New Trade Remedy Investigation into Imports of Unfairly Priced Railway Tank Cars from Mexico

WASHINGTON, Sept. 30, 2026 /PRNewswire/ -- On September 30, 2026, UTLX Manufacturing LLC (UTLX) filed a petition to counter unfairly low-priced and subsidized imports of railway tank cars ("tank cars") from Mexico. UTLX filed the petition with the U.S. Department of Commerce and the U.S. International Trade Commission (ITC) following significant volumes of unfairly priced Mexican tank cars entering the United States. The petition alleges that Mexican importers' unfair pricing practices and subsidies distort the U.S. market and harm American companies and workers.

UTLX is one of the largest industrial employers in Central Louisiana. The company's tank cars transport commodities that are essential to the United States economy and daily life, including energy products, chemicals, plastics, fertilizers, food ingredients, and other critical materials that support American manufacturing, agriculture, infrastructure, and energy security.

Antidumping duties aim to offset the amount a product is sold at less than fair value, or "dumped," in the United States. The dumping margin is calculated by the Department of Commerce. Countervailing duties are intended to offset unfair subsidies that a foreign government provides in the production of a particular good. The ITC, an independent agency, determines whether the domestic industry is materially injured, or threatened with injury, as a result of the unfairly traded imports.

The Department of Commerce will determine whether to initiate the investigations within 20 days of the filing (unless extended by an additional 20 days), and the ITC will reach a preliminary determination of material injury or threat of material injury, within 45 days. The investigations are expected to proceed over approximately one year, with final determinations of dumping, subsidization, and injury likely occurring near the end of 2027. Duties can, however, attach to imports of the subject tank cars as of the time of the preliminary determinations in the case.
