Commil USA Wins $3.7 Million Patent Verdict Against Cisco Systems

MARSHALL, Texas, May 18 /PRNewswire/ -- The Dallas law firm of Sayles Werbner is announcing a $3.7 million patent infringement verdict handed down last night in favor of The Woodlands, Texas-based Commil USA LLC against San Jose, Calif.-based Cisco Systems Inc. (Nasdaq: CSCO) in a legal dispute over wireless network technology.

Commil was represented at trial by Richard A. "Dick" Sayles and Mark S. Werbner, co-founders of Sayles Werbner.

"We are very happy that the jury found our client's patent valid, and confirmed that Cisco wrongly infringed Commil's patent," says Mr. Sayles. "Commil worked hard and went through all the proper channels to develop this valuable technology only to see a giant company use it to make a profit for themselves."

The Commil USA technology contained in U.S. Patent No. 6,430,395 (the '395 patent) allows wireless devices to move from point to point on a computer network without signal interruption. Prior to this groundbreaking invention, network users experienced frequent signal disruptions leading to data losses, dropped calls and other errors. The '395 patent applies to many network platforms, including Wi-Fi.

The lawsuit was filed after Commil USA discovered its technology was being used by a Cisco subsidiary to produce its own Wi-Fi product line.

"We took this case to trial on behalf of hard-working inventors everywhere – whether they're highly trained engineers or garage tinkerers," says Commil USA CEO Jonathan David.

"Following the verdict, the judge raised questions about Cisco's inappropriate trial tactics, and whether Commil USA received a fair trial," says Werbner. "We're now reviewing our legal options."

The Hon. Chad Everingham presided over the weeklong trial in the U.S. District Court for the Eastern District of Texas. Jurors returned their verdict on Monday night following three hours of deliberations. The case is Commill USA LLC v. Cisco Systems Inc., et al., No. 2:07-cv-341.
