D.C. Appellate Court To Hear Oral Argument Over Hillary E-mail Scandal In FOIA Case Filed By Larry Klayman And Freedom Watch In First Court Test For Mrs. Clinton

WASHINGTON, April 1, 2015 /PRNewswire-USNewswire/ -- This Thursday, federal appeals court in Washington, D.C., will hear oral argument in an appeal (14-5174) of the dismissal of a Freedom of Information Act request filed by Larry Klayman of Freedom Watch which sought records concerning Secretary of State Hillary Clinton's likely release of classified information about Israeli war plans and its cyberwarfare techniques to New York Times reporter David Sanger. At the time of this public release of classified information, Israel was thought to be preparing to take out Iranian nuclear facilities with air strikes and other military means. "The presumed reason for this release of information was so the Obama administration would squelch this attack by revealing Israeli sources and methods," said Klayman. In recent days the Obama administration has also released previously classified information about the Israeli nuclear program, as it acquiesces during nuclear talks with Iran to it having similar capabilities.

"Missing from meager previous record production was any correspondence or other documentation from Mrs. Clinton or her office and top aides. However, the few documents that were produced suggest that she did discuss Israeli war plans and cyberwarfare techniques with Sanger, which classified information was then published in columns and books by Sanger. The few records produced also show Mrs. Clinton and her staff had prior contact with The White House national security staff concerning these matters."

Klayman said he will ask the appeals court to send the case back to the lower court with instructions to order seizure of Mrs. Clinton's so-called private servers, reopen the case and allow discovery to proceed to determine the extent of her document destruction, "as it would appear there is an obstruction of justice, since is likely that her so-called private emails are not so private after all."
