Drones Debate: Bari Weinberger Addresses Need for Revamped Privacy Laws In Lead Opinion Piece
New Jersey attorney Bari Z. Weinberger, Esq. of Weinberger Law Group was chosen as the featured essayist in a recent editorial series on privacy laws in the age of commercial drones.
PARSIPPANY, N.J., June 16, 2015 /PRNewswire/ -- With the debate over commercial drone use heating up, the Asbury Park Press asked notable figures from across the state, including family law attorney, Bari Z. Weinberger, Esq., to weigh in on whether New Jersey's laws are equipped to protect citizens' privacy in this new high tech age.
Writing the lead editorial for the series, Ms. Weinberger outlined concerns about commercial unmanned aerial vehicles (UAVs) in light of the FAA's newly released preliminary guidelines on commercial drone use. The interim report provides ground rules on issues such as air height and piloting ability of UAVs, but lacks any mention of how drones will respect personal privacy.
As Ms. Weinberger explained in her piece:
- Drone technology is rapidly changing: Increasingly sophisticated UAVs have the ability to record video and audio, use facial recognition technology, and collect electronic data including signals from cell phones, garage door openers, and radio frequency identification data (RFID) from credit cards.
- Commercial drone use is not limited to package delivery: Private investigators are adding drone surveillance to their offerings in growing numbers. In one reported incident last year, a suspicious wife hired private investigators to fly a drone over Central Park to record video of her cheating husband and his mistress.
- Drones are blurring the line between public and private: In public places, privacy expectations are lowered, but drones could be employed in an attempt to stealthily collect private electronic data in what is considered public airspace.
- Updated Privacy law updates are needed: In California, updated laws now prohibit drone image and voice recordings of people without permission. In New Jersey, it seems practical for lawmakers to review and revise the NJ Wiretapping and Electronic Surveillance Act to include language governing drones and outline tests we might apply for privacy with this new technology.
