SEABROOK, N.J., March 12, 2015 /PRNewswire-USNewswire/ -- Seabrook House confirms today that both Elements Behavioral Health, Inc. and Recovery Brands, LLC have accepted the terms of a settlement offered by Seabrook House. (Case # 1:14-cv-05365-NLH-JS)
"I am pleased at the successful outcome of this lawsuit", said Edward Diehl, President of Seabrook House. "Our intention was to affect a change in their behavior and have them cease using the Seabrook House name in their listings. They did so. Colleagues throughout our industry know of the professional reputation and integrity of Seabrook House's 40 years of service, as a not for profit provider to families struggling with addiction. Our name is our reputation and must never be used by any third party."
In the initial complaint, Seabrook House alleged that both Elements Behavioral Health ("Elements") and Recovery Brands ("Recovery") misappropriated Seabrook House service marks, in various websites, including 4rehabs.com.
To resolve this matter, Elements and Recovery warranted that neither Elements nor Recovery had any record of any person seeking information or treatment from Seabrook House being directed to a facility owned by or related to Elements and have agreed not to affirmatively place any Seabrook House listing on any websites owned or operated by Elements, Recovery or their successors.
Elements further agrees not to authorize the complained of pages in the action to be republished on 4rehabs.com or any other website operated by or on behalf of Elements and agrees not to place any Seabrook House listing on websites owned or operated by Elements or its successors.
"Internet advertising continues to operate like the Wild West. Until there are clear and proven legal guidelines, I encourage all provider colleagues to monitor the use of their name and brand closely," said Diehl.
