FAIR Calls on State AGs to Investigate and Enjoin Discriminatory 'Immigration Neutral' Prosecution Policies

WASHINGTON, July 31, 2025 /PRNewswire/ -- The Federation for American Immigration Reform (FAIR) today announced that it has forwarded the latest investigative report from its supporting organization, the Immigration Reform Law Institute (IRLI), on "immigration neutral" prosecution policies to Attorneys General in 22 states.

IRLI's report, published on July 23, 2025, exposes how certain progressive prosecutors are creating a two-tiered justice system that favors illegal aliens over U.S. citizens, shielding criminal aliens from deportation while denying similar leniency to Americans. FAIR's outreach to the 22 Attorneys General includes a call to investigate and take legal action against these unconstitutional and anti-American practices.

As part of this initiative, FAIR has sent letters to Attorneys General from states featured in IRLI's report, including: Pennsylvania, Virginia, Oregon, Washington, New York, Michigan, Illinois, and Colorado. Additionally, FAIR has also sent letters to Attorneys General in states with robust anti-sanctuary laws that may be vulnerable to covert adoption of "immigration neutral" prosecution policies. Those states include: Florida, Texas, Iowa, Oklahoma, Georgia, Alabama, South Carolina, Arkansas, Kansas, Idaho, South Dakota, North Dakota, Tennessee, and Wyoming.

"These 'immigration neutral' policies are not only anti-American but blatantly unconstitutional, as they disadvantage U.S. citizens in the criminal justice system solely to protect illegal aliens from the consequences of their actions," said Dale Wilcox, FAIR's executive director and general counsel. "We are calling on state Attorneys General to exercise their authority to investigate and enjoin these practices, restoring equal justice under the law. As IRLI's report demonstrates, there is no compelling justification for this discrimination against U.S. citizens, and it must end to uphold American sovereignty and public safety."

IRLI's report highlights jurisdictions where prosecutors prioritize factors like immigration status and family separation when making charging, plea, and sentencing decisions for alien defendants. These practices often result in reduced charges or sentences to avoid triggering federal immigration penalties. IRLI's investigation reveals that such policies, driven by anti-borders ideology and funding from figures like George Soros, have led to tragic outcomes—including repeat offenses by aliens who benefited from leniency.

"Our investigative work uncovers a disturbing pattern: prosecutors in sanctuary jurisdictions are systematically thwarting federal immigration enforcement by treating criminal aliens more leniently than Americans, all under the guise of 'equity,'" said Mateo Forero, IRLI's director of investigations. "This not only erodes public trust in the justice system but also endangers communities by incentivizing illegal immigration and repeat criminality."

IRLI's report builds on its prior work on this issue, including a 2024 exposé on Philadelphia District Attorney Larry Krasner's policies, and a May 2025 letter to Attorney General Pam Bondi calling for federal intervention under 34 U.S.C. § 12601.
