If a Tree Falls, Who's Responsible for the Damage?

Mercury Insurance explains how homeowners coverage, liability and negligence may come into play when fallen trees damage property

LOS ANGELES, Oct. 29, 2026 /PRNewswire/ -- When a tree crashes through a roof, crushes a fence or lands on a neighbor's car, one of the first questions homeowners often ask is who will pay for the damage. Mercury Insurance (NYSE/NYSE TX: MCY) wants homeowners to understand that the answer may have less to do with who owns the tree and more to do with how and why it fell.

Heavy rain, strong winds and saturated soil can increase the risk of falling trees, particularly during the fall and winter storm season. While homeowners may assume that the person who owns a tree is automatically responsible for any damage it causes, insurance claims can be more complicated. Coverage and liability may depend on the circumstances of the incident, the condition of the tree, applicable state laws and the provisions of the insurance policies involved.

"A fallen tree can create a stressful situation, especially when it damages someone else's property," said Bonnie Lee, Vice President of Property Claims at Mercury Insurance. "One of the most important things homeowners should understand is that owning a tree doesn't necessarily mean you're responsible for everything that happens when it falls. The circumstances matter, and knowing what to do after the damage occurs can make the claims process much easier."

When Your Tree Damages Your Home

If a tree on your property falls onto your house during a windstorm or other covered event, your homeowners insurance may help pay for repairs to the dwelling, subject to the policy's terms, limits and deductible.

Coverage may also extend to certain other structures, such as detached garages or fences, although different limits and conditions may apply.

The reason the tree fell can be important. Damage caused by a sudden windstorm may be treated differently from damage associated with deterioration, neglect or other circumstances excluded by the policy.

Homeowners should also understand that insurance coverage for damage to a structure does not necessarily mean the policy will pay to replace the fallen tree itself.

When Your Neighbor's Tree Damages Your Home

A neighbor's tree falling onto your property doesn't automatically make your neighbor financially responsible for the damage.

If an otherwise healthy tree falls during a severe storm, your own homeowners insurance may provide coverage for damage to your house, subject to the policy's provisions. The fact that the tree originated on a neighboring property may not change how the initial claim is handled.

However, the situation may be different if the tree was visibly diseased, dead or otherwise hazardous before it fell.

If the tree's owner knew, or reasonably should have known, about a dangerous condition and failed to address it, negligence may become a factor in determining liability. Whether the owner is legally responsible depends on the facts and applicable law.

In some circumstances, an insurer that pays a covered claim may seek reimbursement from another responsible party or that party's insurer through a process known as subrogation. Recovery is not guaranteed.

When Your Tree Damages Your Neighbor's Property

The same general principles may apply when a tree on your property falls onto a neighbor's home, fence or other structure.

A homeowner is not necessarily liable simply because the tree originated on their property. If the tree fell because of an unexpected storm and there was no indication of a hazardous condition, the neighbor's own property insurance may respond to the damage.

If evidence suggests that the homeowner failed to address a known or reasonably identifiable hazard, however, liability may become an issue.

Depending on the circumstances and policy provisions, the liability portion of a homeowners policy may provide protection if the insured is found legally responsible for damage to another person's property.

"Homeowners shouldn't assume that every fallen tree creates a liability claim," Lee said. "What matters is understanding the condition of the tree before it fell, whether there were warning signs and what actually caused the damage. Those details can be important when an insurance company evaluates a claim."

Who Pays to Remove the Fallen Tree?

Tree removal can create another unexpected expense, and coverage may depend on where the tree lands and whether it damages insured property.

For example, a homeowners policy may provide some coverage for removing a tree that falls onto and damages a covered structure. Certain policies may also provide limited removal benefits in other specified circumstances, such as when a fallen tree blocks a driveway.

However, a tree that falls harmlessly into an open yard without damaging covered property may not qualify for removal coverage.

Even when tree removal is covered, separate limits or restrictions may apply. Homeowners should review their policies and consult their insurance representatives before assuming cleanup expenses will be reimbursed.

Five Steps to Take After a Tree Falls

Mercury recommends that homeowners take the following precautions when a fallen tree damages their property:

      1. Put safety first. Stay away from downed power lines, unstable branches and damaged structures. Contact emergency services or the appropriate utility provider when necessary.
      2. Document the damage. Take photographs or video of the fallen tree, affected structures and surrounding conditions when it is safe to do so. Preserve any existing photographs or records showing the tree's condition before the incident.
      3. Prevent additional damage. Reasonable temporary measures, such as covering a damaged roof opening, may help protect the property from further loss. Keep receipts for emergency repairs and related expenses.
      4. Contact your insurance company. Report the damage promptly and ask about applicable coverage, deductibles, inspections and documentation requirements. If the tree originated on neighboring property, provide that information without assuming who is responsible.
      5. Use qualified professionals. Tree removal can be dangerous, particularly when large branches are resting against buildings or electrical equipment. Consult qualified tree removal professionals and coordinate significant cleanup with your insurer when practical.

A Little Prevention May Help Avoid a Big Problem

While severe weather cannot be controlled, homeowners can take steps that may reduce the likelihood of tree-related property damage.

Regular inspections by qualified arborists may help identify dead branches, disease, structural weaknesses or other conditions that could make a tree more vulnerable to falling. Homeowners should also pay attention to changes in a tree's condition, particularly after major storms or prolonged periods of heavy rain.

If a neighboring tree appears hazardous, communicating concerns to the property owner and maintaining appropriate documentation may be helpful. Local ordinances and state laws can affect property owners' rights and responsibilities regarding trees near property boundaries.

"Trees are an important part of our neighborhoods, but they also require attention and maintenance," Lee said. "Taking potential hazards seriously before a storm and documenting damage carefully afterward can help homeowners protect their property and navigate the claims process with greater confidence."

Homeowners should review their insurance coverage before storm season and speak with their insurance agent or representative about questions involving tree damage, removal expenses and liability protection.
