Individuals who received a notice about the Telmate Data Security Incident could be eligible for money from a class action settlement

PHILADELPHIA, Sept. 21, 2026 /PRNewswire/ -- The following statement is being issued by Kroll Settlement Administration LLC regarding Cooper v. Telmate, LLC, Case No. 1:24-cv-01622 (E.D. Va.).

A Settlement has been reached with Telmate, LLC d/b/a Viapath Technologies ("Telmate") in a class action lawsuit about a data breach in which unauthorized third-party actors accessed Telmate's computer network between August 11, 2020 and August 13, 2020 (the "Security Incident"), compromising the Personal Information of individuals who used Telmate's services, among other claims. Telmate denies all allegations and any wrongdoing.

Telmate provides communication and related services to incarcerated individuals and their connections through platforms such as GettingOut, VisitNow, and other ViaPath Technologies products.

The Settlement Class includes all individuals in the United States whose Personal Information was impacted during the Security Incident.

If the Settlement is approved, Telmate will pay $4,225,000 into a Settlement Fund that will provide cash payments to Settlement Class Members as well as the Costs of Settlement Administration, the Attorneys' Fee Award and Court-approved Cost Reimbursement, and the Service Award. Settlement Class Members can file a claim for a Pro Rata Cash Payment and reimbursement of Documented Out-of-Pocket Loss of up to $5,000 per person.

Claim Forms must be filed online or postmarked by mail by December 21, 2026.

If you do nothing, you will not receive a Settlement Payment, you will remain a Settlement Class Member, and you will give up any right to sue Telmate for the claims resolved by this Settlement. If you do not want a Settlement Payment and do not want to remain in the Settlement Class, you must opt out of it. If you do not opt out, you may object and ask the Court for permission to speak at the Final Approval Hearing. The Opt-Out and Objection Date is December 21, 2026.

The Court will hold a hearing on February 12, 2027 at 10:00 a.m. ET to decide whether to approve the Settlement, up to $1,408,333.33 in attorneys' fees and up to $35,000 in costs, and a $5,000 Service Award. You or your lawyer may attend the hearing at your own expense.
