K-V Pharmaceutical Announces Filing of Fiscal Year 2009 Annual and Quarterly Reports with the Securities and Exchange Commission

ST. LOUIS, March 25 /PRNewswire-FirstCall/ -- K-V Pharmaceutical Company (NYSE: KVa/KVb) ("the Company") today announced the filing of its Form 10-Q's for the quarters ended June 30, 2008 (as amended), September 30, 2008, and December 31, 2008, and its Form 10-K for the year ended March 31, 2009 (the "2009 Form 10-K") with the Securities and Exchange Commission (the "SEC"). As a result, the Company has met the New York Stock Exchange's (the "Exchange") deadline for filing its 2009 Form 10-K to enable its securities to continue trading on the Exchange.  As previously disclosed on December 22, 2009, the Company had requested and received permission from the Exchange for its securities to be permitted to continue to trade on the Exchange until March 31, 2010 while the Company prepared its 2009 Form 10-K.  The Company is currently working on preparing and filing its fiscal year 2010 quarterly reports on Form 10-Q for the quarters ended June 30, 2009, September 30, 2009 and December 31, 2009, in order to become current in its SEC filings, and will file these reports as soon as practicably possible.

In the 2009 Form 10-K, the Company reported that it does not anticipate resuming shipping of its products until the fourth quarter of calendar year 2010 at the earliest. While K-V Pharmaceutical continues to work with the Food and Drug Administration (the "FDA") to return its products to market, its top priority is maintaining and attempting to increase its cash and financial resources. In order to achieve this goal, the Company may decide to further reduce its operations in the future.
