After the 2014 $9 billion verdict against Actos, manufactures Takeda Pharmaceuticals and Eli Lily are in the process of filing post-trial motion, alleging that the Louisiana court's punitive damages were awarded out of "passion and prejudice" and they have requested a new trial. The motion claims the company is entitled to a new review because the award was unconstitutional and excessive. This was the first bellwether case for Actos, while thousands of similar allegation cases are at hand in the courts.

Actos has been successful in turning some cases around; a post-trial motion in May of 2013 reversed a $6.5 million dollar verdict when a plaintiff's expert testimony was excluded in the state court. In September of 2013, when a plaintiff did not properly take care of his own health, under Maryland's contributory negligence law a defense verdict was reached. Most recently, a plaintiff's smoking history was a huge factor in whether or not Actos was at fault for the development of the plaintiff's bladder cancer. This resulted in the defense verdict as well, as seemingly the jury could not ascertain the causation link between the Cancer and either the smoking or use of the possible bad drug, Actos.
