Leading Timeshare Attorney Susan Budowski Issues Second Warning to Timeshare Owners
VENICE, Fla., Dec. 5, 2018 /PRNewswire/ -- Timeshare cancellation Attorney Susan Budowski is providing another consumer protection warning to timeshare owners.
Attorney Budowski warns timeshare owners who need for whatever reason to get out of their timeshare ownership to beware of cancellation companies that are NOT law firms soliciting services to get out of their timeshares. Budowski warns that some of these companies are engaging in UPL, which is the Unlicensed Practice of Law, while others are misleading consumers into thinking they are legal firms by the designs, images and wording on their websites. Budowski says, "they intentionally use imagery that mimics a legal firm; images like the scales of justice, law books on shelves, a Judge's gavel, among others. Then they refer to the matters as lawyers do by calling them cases and boast outrageous claims in numbers of clients, monies saved, you name it, to create an illusion of confidence that they are dealing with some type of successful legal firm, which they are not."
These companies engage clients under the premise they have the legal knowledge to assess their timeshare matter and the means by which to bring a resolution, when in fact they are a DIY (Do It Yourself) letter-writing company. Attorney Budowski goes on to say, "they prohibit their timeshare clients from telling the developers that they even hired them, and the timeshare owner must send letters out themselves, and certainly not on the company's letterhead." What this does is inundate the timeshare developers with meritless form letters which groups a timeshare owner, who actually may actually have a legitimate complaint alongside all the others with little, if any, consideration. Several large developers are in active litigation suing these cancellation companies for a variety of claims.
They even give themselves "faux" industry awards, that of course go nowhere when you click on them for validation.
Attorney Budowski wants to convey the following red flags to look out for and advises owners to stay away from:
- Companies paying for attorney specific keywords in search engines, like timeshare attorney, timeshare lawyer, how to legally cancel your timeshare… "Your matter will never reach the legal department because they are not a licensed law firm."
- Any company that contacts you directly, unsolicited telemarketers, email or mail. "Their pitch is to tell you they understand you are having an issue with your timeshare, as if their call is to help you; they have your ownership information already, which was most likely acquired nefariously, to appear as if they are legitimate, when in fact they are not."
- Companies that try to set an appointment to meet with you in person. "This is a HUGE RED FLAG. Never allow someone to come into your home to talk to you about your timeshare or go meet them anywhere; one of two things will happen - you will get scammed or you will pay 3 to 4 times what you would pay a law firm and more than likely get nothing for the money you just spent. A licensed attorney is not going to set up an appointment at your home, hotel, restaurant, or coffee shop to discuss your timeshare matter."
- Travel Clubs who tell you they can get you out of your timeshare.
"By signing up with them, of course, for many thousands of dollars, telling you how much better off you will be… simply not true in nearly all cases."
