Criminal referral seeks investigation ahead of 207-mile march to facility's gates

ALBANY, N.Y. , Sept. 2, 2026 /PRNewswire/ -- Organizers of the March to Abolish Animal Testing are calling for immediate action after explosive new whistleblower evidence alleging severe cruelty toward dogs at Marshall BioResources was submitted to New York authorities—just 10 days before hundreds of advocates begin a 207-mile march from Albany that will end at the company's gates.

A criminal referral drafted by former federal prosecutor Bonnie Klapper calls for an immediate investigation into the allegations and asks authorities to protect dogs at the facility while the claims are reviewed. The referral is based on eyewitness accounts and other documentation describing alleged severe mistreatment of dogs at Marshall.

The March to Abolish Animal Testing begins Sept. 12 in Albany and is intended to build public pressure for an end to animal experimentation in the United States. The route takes participants across New York to Marshall BioResources, where the event will conclude with a peaceful rally on Sept. 26.

"This evidence changes what we are walking toward," said Ella Magers, co-director of the March to Abolish Animal Testing. "There are thousands of dogs inside Marshall right now, and authorities now have grave allegations in front of them."

For march organizers, the timing is impossible to ignore. The group was already preparing to walk across New York with a letter to HHS Secretary Robert Kennedy, Jr. from over 250 scientists asking him to end the use of dogs in testing. Now, the March will begin with a criminal referral already in the hands of authorities.

"This March is about refusing to look away," said Primack. "People are giving up two weeks of their lives to walk across New York because what happens to animals behind closed doors should matter to all of us. We want the country watching when we arrive at Marshall's gates."
