NEW YORK, Nov. 30, 2016 /PRNewswire/ -- McKool Smith principal Robin Cohen has been recognized as an "Insurance MVP" by Law360. The publication's MVP series honors an esteemed group of attorneys who have distinguished themselves from their peers by securing hard-earned successes in high-stakes litigation, complex global matters, and/or record-breaking deals over the past year. Robin has been recognized as a Law360 Insurance MVP each year since 2013.
Robin is a seasoned trial lawyer with more than 25 years of experience trying and litigating significant coverage disputes. As the head of McKool Smith's insurance recovery practice, she leads an elite group of trial lawyers across offices in New York and California who have built an impressive profile by handling and trying many of the country's largest insurance recovery cases. To date, the group has obtained more than $8 billion in insurance-related recoveries for a wide range of corporate policyholders.
In an extensive feature profile on Robin (available here), Law360 notes that she has "an established reputation as a successful trial lawyer," and over the past year has scored "significant victories against carriers including new holdings over insurance coverage allocation methods."
Most recently, Robin led McKool Smith's team in securing a landmark decision for Warren Pumps LLC from the Delaware Supreme Court. As reported by Law360, the September 2016 decision "reversed a lower court decision, finding that coverage was triggered if any bodily injury incurred during the insurers' policy periods, as opposed to significant exposure to asbestos," and entitles Warren to access hundreds of millions of dollars in insurance coverage for their asbestos-related liabilities. The ruling followed an earlier landmark decision that Robin secured as lead counsel for Warren Pumps before New York's highest court, the Court of Appeals, on an issue of first impression in New York. The decision held that standard form insurance policies containing "non-cumulation provisions" or "prior insurance provisions" allow a policyholder to obtain coverage for its full liability from policies covering any policy year in which some injury took place. Since the decision interprets standard-form language, it has broad, multi-billion dollar implications for coverage nationwide. The ruling topped Law360's report on the "Biggest Insurance Rulings So Far In 2016."
Robin also led McKool Smith's team in securing a preliminary injunction against Lloyd's of London and Axis Specialty Europe SE in April 2016, which ordered the immediate reimbursement and advancement of defense costs incurred by her client, former FIFA official Eduardo Li, who was indicted in a criminal action. The decision affirms a policyholder's right to injunctive relief and recognizes the federal court's obligation to protect criminal defense counsel by ensuring they are properly compensated by insurance.
Robin has been named one of the "Top Ten" insurance litigators in the nation by Benchmark Litigation and one of the 50 Most Influential Women Lawyers in America by The National Law Journal. Her talents have also been recognized in numerous legal publications and directories, including Chambers USA, where she is ranked "Band 1" both nationally and in New York for insurance dispute resolution. The publication's 2016 edition describes Robin as "the real deal" when it comes to policyholder representation and notes that "she is widely renowned as an outstanding trial attorney who is highly skilled at securing large scale recovery and settlements on behalf of her clients." Robin has also been recognized as a leading insurance litigator by The Legal 500 and by Lawdragon 500, who referred to her as "a top-flight advocate for insurance clients."
With more than 180 trial lawyers across offices in Austin, Dallas, Houston, Los Angeles, Marshall, New York, Silicon Valley, and Washington, D.C., McKool Smith has established a reputation as one of America's leading trial firms. Since 2006, the firm has secured nine nine-figure jury verdicts and ten eight-figure jury verdicts. The firm has also won more VerdictSearch and The National Law Journal "Top 100 Verdicts" over the last ten years than any other law firm in the country. Courtroom successes like these have earned McKool Smith critical acclaim and helped the firm become what The Wall Street Journal describes as "one of the biggest law firm success stories of the past decade." McKool Smith represents clients in complex commercial litigation, intellectual property, bankruptcy, and white collar defense matters.
