NUBY Gains Major Victory Over Philips AVENT in Patent Suit

MONROE, La., Dec. 28, 2011 /PRNewswire/ -- Luv n' care, Ltd. - maker of the famous NUBY brand baby products - announced receipt of an extremely favorable decision from the German Court of Appeals today, in its lawsuit against Philips GmbH, parent company of Philips AVENT brand baby products.

Philips was found guilty of infringing Luv n' care's patent on a unique NUBY no-spill cup assembly for use by children and babies. In accordance with the ruling, Philips will be required to immediately withdraw its infringing AVENT products from the German marketplace, destroy those currently in inventory, and pay Luv n' care damages for the sales of all its baby products in Germany that use Luv n' care's patented NUBY no-spill assembly, including, for example, Philips' line of MAGIC CUPS.

Luv n' care also has many additional related patents throughout Europe, Asia, South America, Canada, the United States and other countries.

The decision follows a series of very favorable lawsuits for Luv n' care over the years, including suits against Walgreens, Atico, Royal King in Thailand, Kmart, Sassy, and The First Years, among others. Luv n' care has also filed a further lawsuit recently against Philips in the Eastern District of Texas, for infringement of the same no-spill technology in the United States. In that lawsuit, Luv n' care is seeking a permanent injunction against the continued sale of Philips' no-spill cups and bottles, including triple damages for Philips' willful infringement of four issued Luv n' care patents and a fifth approved patent issuing in January. Moreover, Luv n' care is in the process of preparing and filing additional lawsuits against retailers and manufacturers who willfully continue to copy its protected IP products, with suits to be filed in the near future.
