Nurenberg, Paris, Heller & McCarthy Sues Toledo Group Home and Lucas County Children Services Over Death of Unsupervised 11-Year-Old

TOLEDO, Ohio, Oct. 15, 2026/PRNewswire/ -- Nurenberg, Paris, Heller & McCarthy has filed suit against Lucas County Children Services, Turning Point Residential Services, and Takeyla Brown, whom the complaint identifies as Turning Point's owner-operator. The suit follows the death of 11-year-old De'Vonte Bailey who was left unsupervised and struck by a car while riding his bicycle on Oct. 6, 2025.

The complaint, filed by Nurenberg Paris attorney Molly Ebraheim, alleges that Bailey, who was living in a group home and in the County's custody, should have been properly supervised and not allowed to leave the home without an adult. Instead, he was struck by a car and killed on his bicycle, in the dark, nearly four miles from the group home. The lawsuit alleges that Turning Point and Brown did not exercise reasonable care for his safety and supervision.

"Turning Point had one job: to supervise the children in its care," said Ebraheim. "An 11-year-old should never be able to walk out the door of a group home, get on a bike and ride miles away after dark without an adult. When the County placed De'Vonte there, it was trusting that he would be kept safe. This lawsuit is about finding out what went wrong inside that home and making sure it never happens to another child in the County's care."
