Parent Company of Ballistic Case Co. Files Lawsuit Against Pelican Products, Inc.
Civil Complaint Alleges Patent Infringement in Cell Phone Case Design
FORT LAUDERDALE, Fla., Aug. 8, 2014 /PRNewswire/ -- A.G. Findings & Manufacturing Co. (AGF), parent of Ballistic Case Co., a designer of advanced protection accessories for mobile electronic devices, today announced it has filed a complaint for infringement of its intellectual property rights against Pelican Products, Inc.
AGF filed the complaint in the U.S. District Court for the Southern District of Florida, alleging that Pelican Products' brand "Pelican Progear™ Voyager" infringes upon AGF's United States Patent No. 8,624,111. This infringement of AGF's intellectual property rights associated with the Ballistic line of protective cases for mobile phones constitutes unfair competition.
"Ballistic uses its engineering expertise to produce cases with innovative designs, high-quality materials and industry-leading protective capabilities," said Jason Naylor, president of Ballistic. "As an innovator, we are committed to guarding our proprietary technology and designs in order to provide our customers with high-quality protection for their valuable devices."
Based upon information and belief, AGF claims in its complaint that Pelican's patent infringement is willful and deliberate. AGF's request for relief includes: damages for patent infringement, an award of Pelican's profits from patent infringement as well as AGF's lost profits, and an injunction against the continued sale or importation of infringing cases.
