Parker County Child Care Center Faces Civil Lawsuit for Restraining Children With Duct Tape
DALLAS, Aug. 26, 2014 /PRNewswire/ -- A Parker County day care center exposed for restraining young children with duct tape during nap time is now facing a lawsuit filed by Texas' Rasansky Law Firm on behalf of the family of a child who was illegally restrained.
The lawsuit against Heart 2 Heart Montessori Academy in Willow Park, Texas, just west of Fort Worth, cites photographic evidence and witness accounts that one of the center's owners used duct tape to restrain two toddlers during nap time.
According to the lawsuit filed Aug. 26, Galbraith v. Ruyle's Heart 2 Heart Montessori Academy et al, the center also withheld liquids to reduce diaper changes and placed at least one child alone and unsupervised in a room for an extended period of time.
"Behavior like that is an unconscionable breach of the faith that parents place in child care providers," says Rasansky Law Firm founder Jeffrey Rasansky. "This lawsuit was necessary to ensure that this incident is properly investigated so that no other child is ever treated this way."
The abusive behavior came to light in June after a teacher was shocked by what she saw and took pictures. She quit her job at the school that day and notified parents that she had been instructed by the school owner not to report the incidents.
After the incident, many parents shared that they had suspicions related to their children's behavior issues but could never document or determine the problem. Within a week of pulling their children from the school, parents reported improvements in their children's attitudes and behaviors.
Investigations by the Texas Department of Family and Protective Services and the Willow Park Police Department began in June and are pending.
The school has threatened legal action against those who continue to discuss the allegations.
The preschool implemented changes in an effort to prevent parents from removing their children, including the installation of cameras and regular liquid breaks for children. According to the school, the owner who admitted using duct tape to restrain the children, Pamela Decker, is no longer working at the day care.
