MANASQUAN, N.J., Feb. 16, 2016 /PRNewswire/ -- Fair Rate Funding, a transvaginal mesh lawsuit funding company, reports a verdict in favor of Sharon Carlino and against Johnson and Johnson's (J&J) Ethicon division last week. The lawsuit was one of thousands of product liability actions pursued against J&J's pelvic mesh product TVT. This was the first trial of the TVT, made by the J&J division of Ethicon, to go to a jury. (Carlino v. Ethicon, Philadelphia Court of Common Pleas, Case No. 1306-03470)
During a two-week trial, the jury heard testimony from witnesses including several doctors and Ms. Carlino herself, who was implanted with the product in 2005 to treat a condition known as stress urinary incontinence (SUI).
Carlino alleged a design defect of the Ethicon TVT product and backed it up with medical experts who testified that the device erodes into the body tissue after implanted and prevents tissue from properly growing within the body. This causes severe complications in patients including chronic pain and inability to have intercourse. Despite multiple revision surgeries to remove the product, Carlino's condition had not improved.
The jury agreed and after deliberations, awarded Ms. Carlino $3.25 million in compensatory damages for her pain and suffering, $250,000 to her husband for loss of consortium and $10 million in punitive damages.
"The defense will undoubtedly appeal but the verdict is another example of how juries are viewing the testimony about these dangerous products", said Paul Coppola, President of lawsuit funding firm, Fair Rate Funding. Fair Rate Funding specializes in advancing money to plaintiffs prior to settlement. "Ideally, every victim should get their day in court but with tens of thousands of pelvic mesh cases on the docket, the administrative concerns are overwhelming. Still, we are always pleased to see a positive verdict and hope the manufacturers are nudged closer to settlement."
Recently J&J, Johnson and Johnson has pledged more than $120 million to resolve 2,000 to 3,000 of transvaginal mesh lawsuits filed against them. Currently, almost 30,000 cases are currently pending in the Multi-District Litigation (MDL) in West Virginia.
