The case involved the use of the Gynacare Prosima mesh product, which was implanted in Carol Cavness, an aircraft mechanic who felt a pull in her groin while lifting a heavy object at work.  Cavness sought medical treatment and was diagnosed with pelvic organ prolapse.  The condition was repaired with a Prosima implant and surgery.

Cavness complained of severe pain and problems walking within 1 month of the procedure and continues to suffer from her physical condition according to the complaint filed 2 years later.

Cavness sued Ethicon, a subsidiary of J&J, for her injuries claiming that the company pushed an unsafe and dangerous product into the marketplace despite knowing that there were safer alternatives.  

Plaintiff's attorney offered evidence of Ethicon's own internal memos warning of the product's safety risks.  He also argued that there was a less risky alternative to the product's use and that the product was pushed in an effort to obtain more profits for the company with reckless disregard for patient safety.

Judge Ken Molberg, of the 95th Judicial District in Texas presided over the trial.  And there was some apparent confusion as to the legal definitions contained in the jury instructions designed to make it easier for jurors to decide the case.  Only 2 jurors reportedly found in favor of Cavness, who was escorted out of the courtroom after hearing the verdict.
