Pollack Solomon Duffy LLP: Amicus brief blasts DCF in clients' case involving "medical child abuse" accusations
BOSTON, Dec. 23, 2014 /PRNewswire/ -- POLLACK SOLOMON DUFFY LLP announces that UNC Law Professor Maxine Eichner and a nonprofit advocacy group Mitoaction filed an amicus brief today in Boston Federal Court against Massachusetts DCF, arising from its arbitrary use of "medical child abuse" concepts without adequate safeguards for parental rights. The brief argues that states cannot intervene in parents' healthcare decisions for children when they choose among competing medical professional opinions. The brief criticizes the recent explosion of "medical child abuse" accusations that lack adequate standards to support state interference with parental rights to care for their children. In the pending case, the Complaint alleges how DCF teamed up with psychiatrists at Children's Hospital Boston to threaten parents with a loss of custody if they sought other medical opinions rather than submit to inpatient treatment that ultimately failed. The Complaint and amicus brief seek declarations that DCF violated constitutional rights by interfering with parents' rights to determine the best care for their daughter.
