Custody of Pets in Divorce Cases

Many laws have gone into effect in 2018, but one Illinois law that hasn't gotten as much attention as it deserves is the new law regarding pets in a divorce. On Jan. 1, a law went into effect regarding the custody of pets in divorce cases. Previously, pets had been treated much like any other material asset in a divorce, to be divided up in whatever way best balanced the scales. Now, however, judges are allowed and encouraged to consider the well-being of the pet when deciding which spouse will receive custody, in much the same way that custody of children is determined. Says Bender: "I am pleased that the legal system has finally addressed the issue of pets in divorce. As a retired judge myself, I often served on cases with pet-related conflicts. And now, as a private practice family law attorney who also happens to be animal lover, I'm happy to know that judges will look at pets as beloved members of the family."
Bender re-opened The Law Office of Michael Ian Bender in December 2013 after retiring from his tenure as a Judge of the Circuit Court of Cook County, Illinois, where he served the People of the State of Illinois and residents of Cook County. Bender was assigned to the Domestic Relations Division, Parentage and Child Support Section, where he heard matters involving child abuse, custody, support, parentage, visitation, and college contribution. During this time, he protected the rights of minor children. Prior to becoming a judge, Bender was in private practice for 15 years. He received recognition from the American Institute of Family Law Attorneys and the American Institute of Legal Counsel where he was voted one of the "10 Best" in his field.
