New FINRA and State Rules Address Financial Exploitation of Senior Investors

"A new set of Financial Industry Regulatory Authority (FINRA) rules – recently approved by the Securities and Exchange Commission (SEC) and due to go into effect early next year – along with various state laws, are addressing risks of financial exploitation of senior investors in meaningful ways. The new FINRA rules would allow broker-dealers to delay disbursements of funds or securities when elder exploitation was suspected. Under the new FINRA rules, broker-dealers also would be required to make 'reasonable efforts' to get contact information for a trusted contact person."
Hartnett, who was Missouri's Commissioner of Securities when the state passed similar rules a couple of years ago, said that a dozen or so other states have had legislation filed this year with similar proposals. Hartnett is able to discuss the new FINRA rules and how they compare to similar regulations in various states, as well as how investment firms can utilize these tools to help protect senior investors from abuse: "This is an important area nationwide for changes in the law to help protect senior investors as the senior population continues to grow and seniors are living longer lives."
