If one's nuclear family disintegrates, who gets custody of Fido? In the past, the answer to that question was pretty simple, as courts had been accustomed to treating pets like property. However, U.S. courts are starting to treat pet custody cases the way they treat child custody cases; essentially, the court considers the pet's well-being and happiness, rather than merely settling the issue of who is an animal's rightful owner. Newman shares these tips for obtaining pet custody: "If you are the primary caretaker of a pet or pets, my advice is to keep logs of everything you do for them daily. When the judge is faced with having to decide, evidence of your involvement in vet visits, shopping for pricey pet food, day-to-day management, and setting up play dates with other pups will definitely help your case. Ultimately, you need to be able to show a court that you are and have been during the marriage the primary caretaker for the pet. Keep a journal of the times you take the dog to the vet and a detailed list of what you do to care for your pet. You need to be able to show the judge that your beloved pup will thrive best in your care. Courts do not have an apparatus to measure your love for your pets, but if you are putting time and energy into making sure they are healthy, happy, and well-fed, this will speak volumes. And the court will take notice. My last piece of advice is to not take the matter lightly. I have seen pet custody cases that had to go through an endless string of appeals. Although it is not very common, there can be fierce litigation over who gets to keep the pet or how the expenses are to be shared. I have been involved in settlements where cost is split 70/30 and time is split 50/50, and it is true that there are judges who go to great lengths to consider what will make a pet happy."

Nine Fed Flags About Your Nanny That Should Not Be Ignored

Entrusting your child to the sole care of a stranger is one of the hardest things a parent can do. Obviously, you will have interviewed the nanny/manny and spent some time with them before you leave, but first impressions can be deceiving and, sadly, things can look very different once the door is closed and your car has left the driveway. Curate offers these nine red flags that should not be ignored: "1) She doesn't reply to texts quickly: Obviously, you can't expect the nanny to be able to respond instantly all the time. If she takes several days to respond, she probably doesn't take her job seriously or can't commit, which is another warning sign she's not right for you. 2) She can't set boundaries, or uses forceful discipline: Another conversation worth having with nannies is asking what style of discipline they use. They may let the kids walk all over them and lack the assertiveness to set clear boundaries and rules. 3) Your child is hungry, grumpy and tired when you get home: Within reason, your child should be rested and go to bed with a full tummy. That said, young ones will have their moments and tantrums, which will mean they may refuse to eat and sleep in the nanny's care. 4) The house is regularly a mess when you return: A regularly messy house can be an indication that the nanny doesn't value your home or the safety of your child (e.g., leaving toys strewn everywhere that could be tripped on later). 5) He doesn't provide adequate information about the ups and downs of the day: A nanny who is terse or succinct when you ask about the day/night and won't go into detail could be hiding something. 6) He's regularly on his phone while with the kids: Your nanny needs to keep their phone close at hand in case you call or text, but they shouldn't be 'on it' while the kids are awake, and should avoid being distracted by apps like Snapchat or Instagram. 7) She cancels with less than 24 hours' notice (and no good reason): Life is unexpected, and occasionally something unavoidable may come up and means your sitter will have to cancel last-minute. But if they cancel within 24 hours regularly (particularly without a backup sitter to recommend), it's a sign that they don't take their caregiving commitment seriously. 8) Your kids say negative things about her or become anxious or withdrawn before or after she comes: Anxiety and avoidance is a clear sign that something isn't right. Make sure you let your child know they can tell you about their experiences with the nanny in a safe, non-judgmental place. 9) He doesn't make an effort to get to know your child: Choosing a popular nanny can mean they are often going from one house to the next, and may not really be getting to know your child as an individual. A good nanny will remember small details like your child's likes and dislikes, which school they attend, their sports or hobbies, and possibly their birthday."
