EXPERT ALERTS:
Education Issues From Obama's State of the Union Address
Stephen Spahn
Chancellor
The Dwight Schools
"President Obama reported good news that 'Teachers and principals in schools from Tennessee to Washington, D.C., are making big strides in preparing students with the skills for the new economy -- problem solving, critical thinking, science, technology, engineering, math.' These skills are required for success not only in the new economy, but also in the global economy. Today's American students have the potential to be global leaders of tomorrow. One successful path to global leadership is the International Baccalaureate (IB) curriculum, which more and more schools -- public, private, and parochial -- are adopting here in the U.S. And for good reason: The IB, recognized as the 'gold standard' worldwide balances rigorous, universal, academic requirements with the equally important human objective of creating thoughtful, culturally sensitive, internationally minded critical thinkers and problem solvers who can make our world a better place. The IB is the exact kind of 'more challenging curriculum' that President Obama called for, among other changes, including redesigning high schools and partnering with employers that 'offer the real-world education and hands-on training that can lead directly to a job and career.' The new IB Career Certificate program was developed to do just that."
Spahn, the longest-serving head of school in New York City, is Chancellor of The Dwight Schools with programs and campuses in New York, London, Seoul, Beijing, and on Vancouver Island. He is also a board member of the International Baccalaureate.

Security at Large Events Such as the Olympics
Matt Bruskotter
Assistant Dean for Environmental, Safety, Security and Emergency Management
The University of Findlay
"Olympians are facing many potential security threats, and both the American and Russian governments are making good efforts to do whatever they can to protect Olympians and anyone else attending the games."
Bruskotter, a safety and security expert, is available to discuss large-event security, especially with the recent threat to the Olympic Games in Sochi.

International Arbitration Trends for 2014 (FCPA)
John Roesser
International Arbitration Partner
Alston & Bird in New York
"The trend of global business using international arbitration is on the rise with companies in the midst of arbitration all over the world – including the U.S. However, international arbitration has distinct differences from domestic litigation practices. There are numerous ways to navigate the complexities of international arbitration, and certain trends, such as the FCPA, will affect this in 2014."

Consumer Safety and Product Liability
Jenifer Keenan
Product Liability Attorney
Alston & Bird in Atlanta
"The Consumer Product Safety Commission (CPSC) seems to have fully recovered from the shutdown. After announcing only 12 recalls in October 2013, the commission made up for lost time and announced 21 recalls in November 2013. In addition to being active on the recall front, the CPSC issued a press release early in December 2013 with some startling statistics on holiday decorating injuries. According to the press release, there were approximately 15,000 emergency room visits in 2012 for holiday decorating injuries. The press release also notes that 'the most frequently reported holiday decorating incidents seen in emergency departments involved falls (34 percent), lacerations (11 percent) and back strains (10 percent).'"
Keenan, an expert on product recalls and reporting activities, is available to discuss acts such as Consumer Product Safety Improvement Act, the Virginia Graeme Baker Pool and Spa Safety Act, the Federal Hazardous Substances Act, ASTM F963, and the Flammable Fabrics Act, and is a leading expert on the CPSC's consumer safety complaint database, www.SaferProducts.gov.

Export Control, Sanctions and Free Trade Agreements
Jason Waite
Partner, International Trade and Regulatory Lawyer
Alston & Bird, Washington, D.C.
"Congress is the wild card. If they're going to hold hearings on the sale of a sausage company -- Smithfield -- it certainly wouldn't surprise me if they're going to hold hearings on the sale of a component of IBM."
Waite concentrates his practice on the regulations impacting the global movement of goods, technology and services. He counsels clients on export controls, economic sanctions, customs and free trade agreements, with an emphasis on compliance, transactional matters and strategic planning, and enforcement defense.

Antidumping Proceedings, Trade Agreements, Sanctions and Export Control
Elizabeth Hein
Partner and International Trade and Regulatory Lawyer
Alston & Bird, Washington, D.C.
"The announcement coming out of [the] Commerce [Department on anti-dumping reviews] is a pretty significant announcement. They always had the ability to conduct sampling, but they rarely ever did."
Hein counsels clients on all aspects of international trade matters, including antidumping proceedings, international and bilateral trade agreements, World Trade Organization (WTO) dispute settlements, export controls, sanctions compliance and customs matters. In addition, she provides guidance on international trade and Foreign Corrupt Practices Act (FCPA) compliance in due diligence matters. Further, she has represented clients in front of U.S. government agencies and courts and has participated in proceedings before the Department of Commerce's International Trade Administration and Bureau of Industry and Security (BIS), the International Trade Commission, U.S. Customs and Border Protection (CBP), the U.S. Department of Justice (DOJ), the Court of International Trade and the Court of Appeals for the Federal Circuit.

Global Trade, Investment and Regulation
Eric Shimp
International Trade and Regulatory Policy Advisor
Alston & Bird, Washington, D.C.
"The reality is that the White House needs to bring in Democratic votes in both chambers of Congress to pass TPA. Both industry and Congress will now wait to see if the White House legislative affairs shop swings into motion to help USTR Froman make the pitch for TPA. If he's flying solo in these coming weeks, we'll have our answer."
Shimp advises corporate and public sector clients on global trade, investment and regulatory strategies in Asia, Europe and the Middle East. He has nearly a decade of experience gained as a U.S. diplomat and trade negotiator covering East and Southeast Asia. From 2000-2002, he served as the director for ASEAN and Korean Affairs at the United States Trade Representative (USTR), where he managed U.S. trade policy toward the Association of Southeast Asian Nations, Korea and South Asia. At USTR, he handled an array of trade and investment issues, including work on the negotiations toward the Free Trade Agreement with Singapore, concluded in 2002. From 1994-2001, he served as a United States Foreign Service Officer. During his tenure with the U.S. State Department, he was posted in China, Hong Kong and Washington, D.C.

U.S. Farm Bill Includes Limited Legalization of Industrial Hemp Cultivation
Derek Peterson
CEO
Terra Tech Corp (TRTC)
"As the Farm bill heads to Obama's desk for a signature, a provision that will legalize hemp cultivation at universities and colleges in the US is included. Companies with cultivation experience will be needed to help grow this emerging crop."
Peterson, CEO of Terra Tech Corp (TRTC), a publicly traded company with subsidiaries Edible Garden and GrowOp Technology, is available to discuss this new emerging U.S. crop, the laws around it, the potential industry that can be born from it, and cultivation techniques.
