Trevor Gardner's Lawsuit Claimed Event Organizers Employed Negligent Security and Ignored Substantial Risks of Violence Made Evident By Numerous Previous Shootings
SAN FRANCISCO, Nov. 20, 2015 /PRNewswire/ -- Rosenfeld, Meyer & Susman LLP settled client Trevor Gardner's lawsuit against the San Francisco Lesbian, Gay, Bisexual, Transgender Pride Celebration Committee, Inc. during voir dire on Tuesday, as the parties readied for a multi-week jury trial before the Honorable Suzanne R. Bolanos in San Francisco County Superior Court.
"Mr. Gardner and I are hopeful that the issues raised in this matter will compel real change at San Francisco Pride so that this event can be a safe celebration free from the shocking acts of violence that have plagued it in recent years," said lead attorney Ryan Lapine.
Gardner brought his action after he was shot during San Francisco's 2013 Pride Celebration, causing him life-altering injuries.
The confidential settlement was entered into after the Honorable Ernest H. Goldsmith strongly rejected Defendant's Motion for Summary Judgment. "Even though defendant's event included annual gun violence, defendant failed to sufficiently address a known and specific risk of injury of gun violence," Goldsmith wrote. "It is not 'pure speculation' that defendant's total failure to (1) establish a reasonable perimeter for their event; (2) establish secured entrances; (3) require metal detectors; (4) require bag and attendee checks; (5) provide enough security guards to meet industry standards; and (6) monitor overcrowding as recommended by the San Francisco Police Department in light of annual gun violence was a substantial factor in causing plaintiff's gunshot wound." The Court concluded, "The causal link between defendant's security failures and plaintiff's injury is robust".
