Statewide Coalition To Repeal Michigan's Emergency Manager Law Asks Court Of Appeals To Enforce Law
Stand Up for Democracy coalition supporters gather in response to continued delay of the decision by the Michigan Court of Appeals ordering the petition on the November ballot
DETROIT, June 20, 2012 /PRNewswire-USNewswire/ -- The statewide coalition Stand Up for Democracy filed a legal challenge to the continued delay tactics by right wing elements in the state trying to stop the repeal of the emergency manager petition from making it on the November ballot. The group is asking the court to compel the Michigan State Board of Canvassers to certify the petitions in accordance with the law within the next seven days. The board is scheduled to meet on Tuesday, June 26th in Lansing. Certification of the repeal petition is not on the agenda.
"Justice delayed is justice denied," said Herb Sanders, director of the group.
Detroit Branch NAACP Attorney Melvin "Butch" Hollowell, who filed the motion, agreed.
"It is clear that the right win in Michigan government is seeking to run out the clock with their delaying tactics," said Hollowell. "A quarter of a million voters signed this petition. The Court of Appeals ordered that it should be on the ballot. Now, nearly a week later, there has been no movement to comply with the law. This is unacceptable."
The Michigan State Court of Appeals lifted a stay on an order forcing the Michigan Secretary of State to place the repeal petition of the Emergency Manager "dictator" law on the ballot this November. Yet, implementation of that order continues to be delayed by the state. For months, right-wing elements in state government have been hard at work making sure the petition to repeal the emergency manager dictator law would never make it to the ballot. Although those efforts suffered a major setback in the courts last week, right wing elements in state government continue to find ways to stall the courts' order.
