CROWN POINT, Ind., Sept. 30, 2025 /PRNewswire/ -- The Law Office of Attorney John H. Davis filed Petition for A Writ of Habeas Corpus under Cause Number 2:25-CV-00423 in the Indiana Northern District Court—Davis et al. v. Alabama Department of Human Resources of Limestone County et al.
According to petition, the parents state that Eric Stephen Davis ("Eric") is a nonverbal autistic adult who has been and is being illegally held by Defendant-Limestone County Alabama Department of Human Resources ("DHR") even though Eric is from Indiana—where he was born and resided with his parents in Indiana. Thus, under the Full Faith and Credit Act, Indiana retains Full Faith and Credit over this matter.
The petition further states that, on August 25, 2025, the nonverbal Eric was brought to the Decatur Morgan Hospital Emergency Room in Decatur, Alabama by individuals—still presently unknown—who left Eric at the hospital where Eric was later diagnosed with pneumonia. The above-mentioned Petition further sets forth and alleges that Defendant Limestone County Alabama DHR and its agents provided gross negligent care as to the health and life of nonverbal Eric.
The petition was filed on September 15, 2025 and on September 19, 2025, the Indiana Northern District Court summarily transferred the case to Alabama Northern District Court under Case Number 5:25-CV-01621. On September 30, 2025, the Law Office of Attorney John H. Davis filed a Verified Motion to Return and to Restore Verified Petition for a Writ of Habeas Corpus and Verified Application for a Warrant Under Cause Number 2:25-CV-00423 from the Improper Transfer, Under Cause Number 5:25-CV-01621, in the Alabama Northern District Court.
According to petition and motion, the parents—as plaintiffs—have been denied information as to present location, current health and condition of Eric. Moreover, the petition sets forth that the healthcare of Eric is continually being grossly neglected by individuals who refuse to identify themselves to the parents, who reside in Indiana, and to Eric's relatives in Alabama.
