WRSMH Secures $6M Settlement for Union Worker Injured on Ice-Covered Walkway at NYC Site
NEW YORK, Sept. 10, 2025 /PRNewswire/ -- In a major legal victory highlighting the ongoing hazards facing construction workers, Konstantin Burshteyn, attorney at Wingate, Russotti, Shapiro, Moses & Halperin, LLP (WRSMH), has secured a $6 million settlement for a 29-year-old union laborer who suffered debilitating injuries in a slip-and-fall accident on a New York City construction site.
The client, a member of Local 79, slipped on black ice while walking over a plywood passageway shortly after a routine toolbox meeting. She sustained severe injuries to her neck, back, and right hip, resulting in multiple surgeries including a cervical fusion, arthroscopic hip surgery, and a lumbar laminectomy. The accident significantly worsened her already complex medical history, which included hip dysplasia and a rare genetic condition known as hypophosphatasia.
Despite challenges from the defense—including claims that the hazardous area was "open and obvious" and attempts to discredit the causation of injuries—Burshteyn and his team built a powerful case using expert testimony, life care planning, and economic analysis. Their efforts demonstrated the long-term impact of the incident on the client's quality of life and financial stability, including loss of wages, benefits, and future medical needs.
"This case was about more than just a fall—it was about holding those responsible accountable for failing to ensure a safe work environment," said Konstantin Burshteyn, lead counsel on the case. "Our client has endured years of pain and legal battles, and we're proud to have secured the compensation she needs to move forward."
The settlement was reached through private mediation just before trial was set to begin in Kings County, following the denial of defense motions for summary judgment under Labor Law Sections 241(6) and 200.
