A Settlement has been reached in a putative class action lawsuit against DaVita Inc. regarding a criminal Ransomware Attack in April 2025
DENVER, Oct. 20, 2026 /PRNewswire/ -- A settlement not to exceed $15,000,000 has been reached in a putative class action lawsuit against DaVita Inc. ("DaVita" or "Defendant") regarding a criminal Ransomware Attack perpetrated against Defendant in April 2025 and resulting in the potential unauthorized access to Settlement Class Members' Personal Information. The Personal Information involved varied by individual, and may have included names, addresses, dates of birth, Social Security numbers, health insurance-related information, and other identifiers internal to DaVita, as well as certain clinical information, such as health conditions, other treatment information, and certain dialysis lab test results. For some individuals, the information included tax identification numbers, and in limited cases images of checks written to DaVita.
The following are additional details regarding the Settlement.
Who is Included? The Settlement makes relief available to a Settlement Class that includes all U.S. persons whose Personal Information was potentially accessed without authorization in the Ransomware Attack.
What Does the Settlement Provide? Settlement Class Members may claim the following Settlement benefits: (i) a Pro Rata Cash Payment currently estimated to be $50; (ii) 3 years of one-bureau credit monitoring and identity theft restoration services; and (iii) up to $2,500 in reimbursement for Documented Out-of-Pocket Losses. Settlement Class Members may submit a claim for any or all of the above-listed benefits.
Pro Rata Cash Payments and reimbursements of Documented Out-of-Pocket Losses that Settlement Class Members receive may be subject to a pro rata (a legal term meaning equal share) increase or decrease depending upon the total value of timely and valid claims made under the Settlement.
A Settlement Class Member must file a Claim Form to receive any benefits as part of the Settlement. The Claim Form can be filed online at www.DVACyberAttackSettlement.com or downloaded from that same site to fill out and mail. Settlement Class Members may also call 1-877-239-8791 and ask that a Claim Form be mailed to them. The deadline to mail your Claim Form or submit it online is January 19, 2027.
Other Options. If a Settlement Class Member does not want to be legally bound by the Settlement, he or she must submit a request for exclusion (or "opt-out"), postmarked by December 21, 2026, to the Settlement Administrator. If a Settlement Class Member does not opt-out, he or she will give up the right to sue and will release the Defendant and Released Parties about the legal claims and Released Claims in this lawsuit. If a Settlement Class Member does not opt-out, he or she may object to the Settlement and/or the requested Attorneys' Fees, Costs, and Expenses, the requested Supplemental Attorneys' Fees, and the requested Service Awards by December 21, 2026. The Long Form Notice at www.DVACyberAttackSettlement.com explains how to opt-out or object. If a Settlement Class Member does nothing, he or she will get no Settlement benefits and will be bound by the Settlement and any judgments and orders the Court issues.
The Court will hold a Final Approval Hearing on February 18, 2027, to consider whether to approve the Settlement and Class Counsel's requests (i) for Attorneys' Fees, Costs, and Expenses of up to one-third of the $10,000,000 Settlement Fund plus reasonable litigation costs, (ii) Supplemental Attorneys' Fees up to $1,500,000 (to be paid as part of the Supplemental Payment Amount), and (iii) $2,500 Service Awards for each Class Representative. The Court will also address any objections that are timely filed. A Settlement Class Member or his or her lawyer may attend and speak at the hearing if the Settlement Class Member objects and submits the required information (as detailed in the Settlement Agreement and Long Form Notice). However, Settlement Class Members are not required to attend the hearing whether or not they object.
