CHICAGO, Sept 4, 2012 /PRNewswire/ -- Federal Judge Gary Feinerman issued a landmark ruling on August 31, 2012, in an international child abduction case in favor of Marcin Tlustochowicz, who was represented by Andrey B. Filipowicz of the Law Offices of Jeffery M. Leving, Ltd. Judge Feinerman ruled that Mr. Tlustochowicz's wife's removal of their son from the United States to Poland was wrongful, within the meaning of Article 3 of the Hague Convention on the Civil Aspects of International Child Abduction. Judge Feinereman's ruling came after a court in Poland requested that Mr. Tlustochowicz seek such a ruling from a United States Court.
"This case is unusual in that it marks a new found cooperation between courts of different countries working together to implement an international treaty, across international and jurisdictional boundaries," said attorney Jeffery M. Leving, a leading authority on international child abduction cases.
The attorneys for Mr. Tlustochowicz worked swiftly and tirelessly on behalf of their client. The Article 15 Petition was filed on July 11, 2012, and Judge Feinerman put the matter on an expedited schedule, as the Polish Court is scheduled to conduct hearings on September 17, 2012. The ruling came in the wake of a full day of trial on August 30, 2012. The wife, who testified via telephone link, came under the sharp cross examination of Mr. Filipowicz.
At the conclusion of the proceedings, Judge Feinerman took the step of praising the professionalism and skill of Counsel Andrey Filipowicz.
Filipowicz commented that, "I am pleased that my client's position was vindicated by the Judge. This is a necessary step on the path to the reunion of father and child. My client has done everything in his power to secure the return of his son, and I am proud of the role my Firm has played in making that reunion possible."
