Consumers Who Have a Lennox Air Conditioning or Heat Pump System Could Get Benefits from a Class Action Settlement
NEW YORK, Oct. 28, 2014 /PRNewswire-USNewswire/ -- The following is being released by the court-appointed claims administrator about the class action Settlement in Abbott v. Lennox Industries Inc.
A Settlement has been reached with Lennox Industries Inc. ("Lennox"). The lawsuit claims a particular condenser coil that was manufactured between 2005 and 2007 and used in certain of Lennox's air conditioning and heat pump systems is defective because it prematurely corrodes and turns white. Lennox denies these claims and maintains it did nothing wrong. The settlement resolves these claims.
Consumers who have potentially affected systems can get: 1) free replacement of their coil if they have not yet replaced it or had repairs or 2) reimbursement for costs if they have already had their coil replaced. Consumers can get reimbursed for out-of-pocket repairs up to $300 without itemized proof, and perhaps more, depending on the level of documentation of replacement costs they can provide.
Consumers are eligible for benefits only if they live in the United States and own residential property in Florida that has installed an eligible Lennox-brand air conditioning or heat pump system that may have or may have had a white coil. Eligible systems must have both a model number and a serial number within the range of serial numbers of included systems. A list of included systems is available at www.LennoxCoilSettlement.com.
The model and serial numbers for systems can be found on the nameplate or sticker, located near the service panel. This sticker should have a white background with black letters. For an image showing the location and sticker, go to: http://www.lennox.com/res/images/site/serial-airconditioner.gif.
Important Information and Dates:
- To get replacement of a coil or reimbursement for repairs, consumers must file a claim, online or by mail, by March 27, 2015.
- Consumers who want to keep the right to sue Lennox must exclude themselves from the settlement by December 29, 2014.
- Consumers who stay in the settlement can object to it by December 29, 2014.
- Consumers who do nothing are included in the settlement but will not receive a payment unless they submit a claim.
- The Court will hold a hearing on January 26, 2015 to consider whether to approve the settlement and award attorneys' fees, costs, and expenses up to a certain amount.
- Consumers may hire a lawyer to appear and speak at the hearing at their own expense.
