SUNNYVALE, Calif., Nov. 10, 2014 /PRNewswire/ -- TERiX Computer Service, a leading independent multivendor support service company commented today on a ruling by Judge Grewal of the California 9th District Court.
In April 2014, TERiX filed Antitrust and other claims against Oracle Corporation, that Oracle attempted to have dismissed by the Court. On November 7, 2014, the Court ruled that TERiX Sherman Act, Unfair Competition, and Cartwright Act violations by Oracle would survive the motion to dismiss and remain in the case, currently set for jury trial this coming summer of 2015.
"This is a great victory for customers that we believe have been forced to pay a great deal for unneeded or unwanted support for Sun hardware in order to obtain necessary support for other Sun hardware", stated Bernd Appleby, TERiX CEO and Managing Partner. While some TERiX Affirmative Defenses filed were dismissed in the ruling, TERiX does not regard the dismissals as a setback because the Court allowed "leave to amend" and TERiX intends to immediately provide further justification for the Affirmative Defenses to the Court.
Significantly, the Court also ruled that the claim of Oracle interference with certain TERiX contracts and customers survives and the Court has opened the door for TERiX to add additional customers that TERiX alleges Oracle has interfered with.
