Current or former employees of an employer that received a quote or group insurance from United of Omaha Life Insurance Company who were notified of a Data Incident impacting United of Omaha Life Insurance Company's System in 2024 may be eligible for a payment from a class action settlement

PHILADELPHIA, Feb. 28, 2025 /PRNewswire/ -- The following statement is being issued by Kroll Settlement Administration regarding Skinner v. United of Omaha Life Ins. Co. pending in the District Court of Douglas County, Nebraska No. D01CI2400006396.

What is this about?
A Settlement has been reached in a class action lawsuit ("Lawsuit") about a data incident that occurred between April 21 and April 23, 2024, which potentially exposed personally identifiable information ("PII") of current or former employees of an employer that received a quote or group insurance from United of Omaha Life Insurance Company ("Omaha") (the "Data Incident"). The Lawsuit alleges that Omaha was responsible for the Data Incident because it did not take appropriate care to protect PII it collected. Omaha denies the claims and denies any wrongdoing. Omaha has not been found liable of anything by any court.

What does the Settlement provide?
The Settlement will reimburse eligible Settlement Class Members who submit claims for: (1) unreimbursed, documented out-of-pocket expenses and compensation for lost time that resulted from the Data Incident, up to a maximum of $1,500 per person; and (2) two years of credit monitoring and identity theft insurance.

Alternatively, Settlement Class Members are eligible for an Alternative Cash Payment of $50 if they choose not to make claims for the Compensation for Losses or Reimbursement for Lost Time.

How to get benefits?
Settlement Class Members must submit a claim form, along with any supporting documentation, to receive any benefits from the Settlement. Claim Forms can be found and completed on this website: www.OmahaLifeInsuranceDataSettlement.com. The deadline to submit a Claim Form is May 29, 2025.

What rights do Class Members have?

• Do Nothing. Settlement Class Members who do nothing will not receive any benefits and will lose the right to sue regarding any issues relating to this action and will be bound by the Court's decisions.
  
  
• Opt Out: Settlement Class Members may exclude themselves from the Settlement. They will get no benefits from the Settlement, but they keep the right to sue about the claims resolved by this Settlement. Requests for exclusion are due by April 29, 2025.
  
  
• Object: Settlement Class Members who do not request exclusion can object to the Settlement. Objections are due by April 29, 2025.

The Court will hold a Final Settlement Approval Hearing on June 25, 2025, at 9 a.m. at the Douglas County Hall of Justice, Courtroom 412, 1701 Farnam Street, Omaha, Nebraska 68183, to consider whether to approve the Settlement. The Court will hear objections, determine if the Settlement is fair, and consider Class Counsel's request for attorneys' fees, costs, and expenses of $300,000 and service awards of up to $1,500 for each of the Representative Plaintiffs. You or your own lawyer may ask to appear at the hearing to be heard by the Court, but you do not have to. The motion for attorneys' fees, costs, and expenses, and service awards for the Representative Plaintiffs, will be posted on www.OmahaLifeInsuranceDataSettlement.com after it is filed with the Court. Settlement Class Members may hire an attorney, at their own expense, to appear at the hearing, but they don't have to.
