Mr. Bitkower joins the firm's White Collar Defense and Investigations Practice.
"David's accomplishments for the DOJ and US Attorney's office are impressive. His addition strengthens and expands our depth in our White Collar Defense and Investigations Practice while adding another former high-ranking government official to our DC office ranks," said Jenner & Block Managing Partner Terrence J. Truax.
"With his arrival to our firm and our DC office, David will play an important and senior role in our investigations practice," said Craig C. Martin, Chair of the firm's Litigation Department. "We are looking forward to his contributions to our practice and the ways in which he can help us as we assist clients with their most important matters in this area."
"We are pleased to welcome David to the firm and to our White Collar Defense and Investigations Practice," said Reid J. Schar, a firm partner and co-chair of the practice. "Our clients rely on us for the highest levels of excellence in these often high-profile and sensitive matters. David's background and experience is an excellent fit for our clients' many types of complex, sophisticated and often discreet matters."
As principal deputy assistant attorney general of the DOJ Criminal Division, Mr. Bitkower managed the division's more than 700 federal prosecutors who conduct nationally significant investigations and prosecutions in cases involving white collar crime, public corruption, cybercrime, intellectual property, money laundering, and organized and transnational crime, among other areas. Together with other senior DOJ leaders, Mr. Bitkower oversaw the department's most significant investigations and prosecutions of corporate wrongdoing, including financial institution fraud, sanctions evasion, FCPA violations and corporate health care fraud.
Mr. Bitkower also supervised matters arising from cyber intrusions and data breaches, including the federal criminal investigations into large-scale data breaches targeting certain Fortune 50 companies. Along with his colleagues, he was also responsible for developing, implementing and articulating departmental enforcement policies, such as the FCPA Enforcement Plan and Guidance ("FCPA Pilot Program"), and the department's approach to cybersecurity and cross-border data access in criminal investigations.
At the DOJ, Mr. Bitkower also served as a deputy assistant attorney general, and prior to that he was an assistant US Attorney in the Eastern District of New York. At the Eastern District of New York, he was an experienced trial lawyer, and briefed and argued numerous appeals in the US Court of Appeals for the Second Circuit. He also led the Office's National Security and Cybercrime Section, and prosecuted a number of prominent terrorism cases including the trial of an al-Qaeda plot to bomb the New York City subway system.
"David's first-hand knowledge of crucial enforcement decision points and his background working with key regulatory players will further expand our firm's renowned capabilities in white collar defense and investigations," said Samuel L. Feder, managing partner of the firm's Washington, DC office. "His cyber and national security experience will also expand Jenner & Block's focus on privacy issues and government contracts."
"Having lived and breathed white collar litigation, internal investigations and cybersecurity issues for many years, I am very pleased to continue working in these areas at Jenner & Block," said Mr. Bitkower. "I look forward to contributing my talents to building this top-tier practice alongside the firm's well-established practitioners."
Mr. Bitkower clerked for the Hon. Leonard B. Sand of the US District Court for the Southern District of New York and the Hon. Pierre N. Leval of the US Court of Appeals for the Second Circuit. He received his J.D. magna cum laude from Harvard Law School and his B.A. cum laude from Yale University.
ABOUT JENNER & BLOCK'S WHITE COLLAR DEFENSE AND INVESTIGATIONS PRACTICE
Jenner & Block represents individuals and businesses in criminal prosecutions, grand jury investigations, extradition proceedings and civil enforcement actions brought by state and federal agencies, including the Securities Exchange Commission. The practice's high level of credibility with prosecutors enables minimization of the damage and disruption caused by these proceedings, often before charges are brought. If an indictment or charge cannot be avoided, Jenner & Block's white collar lawyers can advise on the risks and benefits of going to trial versus accepting a plea, and have the experience and expertise to take the matter to trial if necessary. The practice group's lawyers conduct internal investigations for companies that are faced with internal or external allegations of wrongdoing or that want to audit proactively for potential misconduct.
