Federal Court Awards Zensights LLC Restraining Order Against TGaS Advisors, LLC

SCOTTSDALE, Ariz., April 22, 2016 /PRNewswire/ -- A United States Federal District Court sitting in the Eastern District of Pennsylvania issued this morning a temporary restraining order enjoining TGaS Advisors, LLC, Gary Warner, and Alice von Loesecke from using confidential information and trade secrets of Zensights LLC. Zensights alleges in its legal filings that TGaS feigned interest in a potential acquisition of Zensights in order to obtain the company's trade secrets. Zensights' complaint contends that TGaS then used the information to develop a competitor product to Zensights' Vendor Analysis Tool—which has been available since 2014—despite the fact that TGaS, Warner, and von Loesecke all signed binding confidentiality and nondisclosure agreements. Zensights included a specific example of customer confusion already created by the substantial similarity of TGaS's would-be competitor, and claims that further use of Zensights' confidential information and trade secrets by TGaS will cause irreparable harm to Zensights' business.

Following a hearing on April 21, 2016, Judge Michael Baylson issued a temporary restraining order prohibiting TGaS, Warner, and von Loesecke from "marketing, selling, disseminating, advertising, or displaying … any existing or anticipated vendor comparison tools or software that are based on Zensights' Vendor Analysis Tool and Zensights' Confidential Information and/or trade secrets." The Court also scheduled a preliminary injunction hearing for May 3, 2016.
