Governor Rendell Signs Legislation Establishing the Construction Workplace Misclassification Act

HARRISBURG, Pa., Oct. 13 /PRNewswire-USNewswire/ -- Governor Edward G. Rendell today signed into law House Bill 400, establishing the Construction Workplace Misclassification Act.

The legislation provides criteria for classifying a person as an independent contractor as opposed to an employee in the construction industry. Failure to withhold unemployment compensation contributions or workers' compensation premiums shall not be a factor in determining whether an individual is an employee or an independent contractor.
