Lawsuit Filed Against Broward Health, Pediatrix and Staff for Medical Negligence and Falsification of Records
Mother asserts defamation, wrongful felony arrest, public humiliation, and temporary loss of custody following hospital incident
DAVIE, Fla., Oct. 7, 2025 /PRNewswire/ -- Winston Law (winstonlaw.com) has filed a civil complaint in Broward County, Florida, on behalf of a mother and her infant son against North Broward Hospital District (Broward Health Medical Center) and other medical personnel, stating the intentional falsification of hospital records that led to wrongful criminal charges, public humiliation, and the temporary separation of the mother from her child.
The suit, filed in the 17th Judicial Circuit Court, also names Pediatrix Medical Group of Florida, Inc., multiple physicians, nurses, and social workers as defendants in the case.
The complaint details that in September 2023, the twelve-month-old son of Jesus was inadvertently administered fentanyl while a patient at Broward Health Medical Center, leading to a life-threatening overdose. The lawsuit outlines that following the incident, hospital staff and associated medical professionals engaged in a coordinated effort to conceal the medication error.
According to the filing, this concealment included falsifying medical records to state there was no documentation of fentanyl being administered during the hospital stay. These records were then provided to the Department of Children and Families (DCF) and the State Attorney's Office.
As a direct result of these actions, the complaint states that Jesus was wrongfully arrested on felony child abuse charges, suffered public humiliation, and was temporarily separated from her child. The lawsuit brings forward multiple counts against the defendants, including medical negligence, gross negligence, defamation, false arrest, malicious prosecution, and intentional infliction of emotional distress. The plaintiff seeks damages more than $50,000 and seeks leave to claim punitive damages against the individual defendants named in the suit.
