McDole Williams: Federal Court Permanently Prohibits TechCruiser.com From Using Stolen Trade Secrets, Awards $2+ Million in Damages to bulletlink.com Owner

DALLAS, Nov. 15, 2017 /PRNewswire/ -- In the United States District Court for the Northern District of Texas, Judge Sidney Fitzwater has enjoined Kunal Raina and his companies TechCruiser, TechCruiser Solutions and TechCruiser.com from using content management systems (CMS) and other trade secrets he was found to have stolen from his former employer Salim Sindhi, owner of bulletlink.com, which provides content management systems (CMS) to publishers of online newspapers. The court also awarded more than $2 million in damages to Sindhi.

"Mr. Sindhi developed unique source code to run the CMS that he provides to customers through bulletlink. His source code constitutes a highly proprietary and valuable trade secret for his business," said Steven Williams, Partner at McDole Williams, the Dallas intellectual property law firm that represented Sindhi. 

Raina worked for Sindhi and bulletlink for several years, during which time Raina obtained a copy of Sindhi's CMS source code, as well as other trade secrets, including customer lists and business plans. Operating from within bulletlink's offices, Raina used these trade secrets to set up his own internet business, called TechCruiser Solutions, to compete directly with bulletlink.

In addition to prohibiting Raina permanently from using the stolen CMS software or other trade secrets, in its final judgment, the court further enjoined Raina from doing business with any other company to provide CMS services to customers based on the stolen trade secrets. Sindhi was awarded damages of $2,090,241, plus interest and attorney's fees.

The court also issued a bench warrant for Raina's arrest for failing to appear or respond to Sindhi's complaint that Raina had violated an injunction issued by the Court in November 2016.
