McDonald Hopkins issues alert on the new FLSA regulations taking effect on Dec. 1

CLEVELAND, Nov. 15, 2016 /PRNewswire/ -- McDonald Hopkins, a business advisory and advocacy law firm, issued an alert on the December 1, 2016 effective date for the new Fair Labor Standards Act (FLSA) regulations. If your organization has not already assessed the impact of these changes and developed a plan for implementing them, employers have only weeks left.

The alert, which was authored by Miriam Rosen, Chair, of McDonald Hopkins' labor and employment practice, discusses the new regulations that will raise the minimum weekly salary level for the FLSA's white-collar exempt positions to $913, which is the equivalent of $47,476 annually. Employers should use this regulatory change as an opportunity to review the classification of all exempt positions, regardless of salary level. Positions that meet the exempt status duties test are not always clear cut and changes in responsibilities and technology can muddy the waters even further. This is an opportunity to review and fix misclassification errors.
